These Terms of Service are effective immediately for all users.

Welcome to Creative Loop. These Terms of Service ("Terms") govern your access to and use of our website, services, and any related content. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using Creative Loop's website and services, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

Important: These Terms constitute a legally binding agreement between you and Creative Loop.

2. Services Overview

Creative Loop provides digital marketing, web design and development, branding, and related creative services to businesses primarily in Bali, Indonesia. Our services include but are not limited to:

Digital Marketing & SEO

Graphic Design

3D Rendering & Animation

3. User Eligibility

You must meet the following requirements to use our services:

  • ✓Be at least 18 years of age or the age of majority in your jurisdiction
  • ✓Have the legal capacity to enter into binding agreements
  • ✓Not be prohibited from using our services under applicable laws

4. Service Agreements & Terms

4.1 Agreement Date & Duration

This agreement shall commence upon the signing of the proposal/agreement and shall remain in effect until completion of services or until terminated by either party with written notice.

4.2 Payment Terms

Standard Payment Schedule:

  • 50% deposit - Required upon approval of this agreement to begin work
  • 50% final payment - Due upon project completion and before website launch
  • Monthly retainer services - Billed in advance on the 1st of each month
  • Late payments - Subject to 2% interest charge per month

Important: Website files will only be released upon receipt of final payment in full.

4.3 Project Timeline & Process

Standard Timeline: Service provider requires 30 days to complete the website after:

  • Client approves the initial design
  • Client provides all required content
  • Deposit payment is received

Revision Limit: Maximum of three (3) revision rounds from the main design are included. Additional revisions will be billed at our standard hourly rate.

4.4 Website Content Responsibility

The client agrees and is responsible for:

  • Providing all website content (text, images, videos) in electronic form
  • Ensuring all content is accurate, legal, and properly licensed
  • Providing final approval of all content before submission
  • Timely delivery of content to avoid project delays
  • Guaranteeing rights to use all provided materials

4.5 Web Hosting & Domain Services

Web hosting and domain services require a separate agreement from the website development service. Clients have two options:

Option 1: Creative Loop Hosting

We can manage your hosting and domain services for you.

  • Full-service hosting management
  • Domain registration and renewal
  • SSL certificate included
  • Regular backups and security
  • Technical support included
  • Monthly or annual billing

Note: Pricing varies based on website requirements. Contact us for a quote.

Option 2: Self-Managed Hosting

Choose and manage your own hosting provider.

  • Client selects hosting provider
  • Must allow full website access
  • Client handles renewals directly
  • Client pays hosting fees to provider
  • Client activates required features
  • Provide access credentials to us

Note: Some features may require activation/purchase from your hosting provider.

Important: Regardless of hosting choice, domain and hosting fees are separate from website development fees and are billed accordingly.

4.6 Website Maintenance

Once the website is completed and launched, the client shall be responsible for:

Content Updates

Text files, images, videos, and other media content

Technical Maintenance

Security updates, backups, and server management

5. Intellectual Property Rights

5.1 Client-Owned Content

Upon full payment, you own the final deliverables created specifically for you. We retain the right to showcase the work in our portfolio unless otherwise agreed.

5.2 Creative Loop Rights

Creative Loop retains the right to showcase completed work in our portfolio and marketing materials unless otherwise agreed in writing.

5.3 Third-Party Assets

Stock photos, fonts, and other third-party assets may require separate licenses. We will inform you of any licensing requirements and associated costs.

6. Client Responsibilities

To ensure successful project completion, clients must:

Timely Feedback

Provide feedback within agreed timeframes to avoid project delays

Required Materials

Supply all necessary content, images, login credentials, and information

Accuracy

Ensure all provided information is accurate and legally compliant

Rights & Permissions

Guarantee you have rights to all materials provided to us

7. Project Cancellation & Refunds

Cancellation by Client

You may cancel a project at any time. Refunds are calculated based on work completed:

  • Before work begins: Full refund minus 10% administrative fee
  • Work in progress: Prorated refund for work not yet completed
  • Completed deliverables: No refund

Cancellation by Creative Loop

We reserve the right to terminate services if you breach these Terms, fail to make payments, or if the project is not feasible. In such cases, you will receive a prorated refund for work not completed.

8. Warranties & Disclaimers

Limited Warranty

We warrant that services will be performed in a professional manner consistent with industry standards. However:

  • We do not guarantee specific results (e.g., search rankings, sales, traffic)
  • Marketing results depend on many factors outside our control
  • Third-party platforms (Google, Facebook, etc.) may change policies
  • Website compatibility across all devices/browsers is not guaranteed

9. Limitation of Liability

To the maximum extent permitted by law, Creative Loop shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages exceeding the amount paid for services in the past 12 months

Note: Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. Legal Compliance & Client Responsibility

Client Legal Responsibility: All legal matters pertaining to the website content, business operations, and compliance with applicable laws are the sole responsibility of the client.

  • The client is responsible for ensuring all website content complies with applicable laws and regulations
  • The client warrants that all provided content does not infringe on any third-party rights
  • The client shall hold Creative Loop harmless from any legal violations or disputes arising from website content or business operations
  • Creative Loop shall not be involved in or held liable for any legal violations committed by the client

Important: The client agrees to indemnify and hold Creative Loop harmless from any claims, damages, or legal actions arising from the client's use of the website or content provided.

11. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of our working relationship. This obligation survives termination of services.

12. Governing Law

These Terms are governed by the laws of Indonesia. Any disputes arising from these Terms or our services shall be resolved through arbitration in Bali, Indonesia, or through the courts of Bali if arbitration is not possible.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by email or through a notice on our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
